Code Violations

See the whole sordid saga and silly cartoons … Oceansidetrees.com

The neighbors all have houses built in the 40’s, during the war, made with green lumber (untreated). They are all on their last legs, needing to be rebuilt. These houses peel and constantly are in need of scraping, painting and remodeling (without a permit?) .

Our home was built in 1992.

Preface to my obsession with code violators on my cul-de-sac…
In the twelve years I’ve lived here, I’ve never been interested in what my neighbors did…I used to have the live and let live attitude; never paid attention to them unless they were coming into my home for a friendly visit. However, when they started giving us orders, bullying, cursing, threatening , telling us to move, flipping the bird, showing hiny, spraying our car, grabbing crotches and lunging at my son’s car, ordering me to get off the street, get in the house, calling the police and code enforcement on us and friends for bogus reasons (parking on the public street and washing bird feces down the ditch), interrogating visitors when they park on our street “Can I help you, or who are you looking for?” They started a war with us to make us want to move, not realizing we aren’t going anywhere, and we are willing to fight back! Now everything these neighbors do in my sight, I’m making my business.

We’ve been attacked by these neighbors, and we are fighting back with the truth about their code violations, but City of Oceanside doesn’t like getting involved in neighbor squabbles, therefore, overlooking the rules they’ve written.

This isn’t about a squabble, these are real and dangerous code violations!

Tree Lady had no driveway when she moved in. She cut the city curb without getting a permit. During a neighborly conversation with my son, before all our problems came down, she bragged about how she’d done all this behind the city’s back, cutting the curb on a Sunday, when no code enforcement were around, very proud of herself.

We decided when Tree Lady started being unneighborly that she deserved the same. We took photos of her curb cut and driveway, and went to the city engineer. He took one look and said it was all wrong; the curb was too high, a tripping hazard, the grade wasn’t right, and she wasn’t even supposed to have a driveway there. We put our complaint into code enforcement. The city has told her to grind down the concrete, but is not going to do anything else. At first they just blew it off, but we are very persistent and will do what we can to remedy this problem. We heard the other day that they probably won’t make her do anything. I will write the mayor next.

I’m beginning to see a pattern here. Government likes to turn a blind eye to all the rules and regulations that we pay them to create. Guess those are just for the purpose of busywork. And when someone breaks those rules, they don’t care. Government has people on the payroll to enforce rules, so do they only enforce rules they deem important? Why not get rid of all home restrictions such as building permits, just let everyone do whatever on their own propety. Couldn’t government be saving money by not making rules that aren’t going to be enforced? Perhaps they could do on less employees since they wouldn’t have so many  complaints about rules being broken.

Tree Lady was in the middle of a kitchen remodel, and guess what… no permit for that either. They stopped her remodel, don’t believe she’s going to be fined by the city. Do we want our canyon up in flames because her wiring didn’t get inspected?

Tree lady turned us in for washing bird feces down the drainage ditch, which was a bogus complaint because we use cat litter in the bottom of our cages and we dump that. More birds flying overhead deposit more poop in that ditch than our cage cleaning.

We called code enforcement on her two weeks later, because she was using that same drainage ditch to wash her chlorine pool filters. Code enforcement showed up while she was in the act. Now, I’m thinking Tree Lady isn’t too smart about what is environmentally unsafe. Bet she wasn’t fined for that either. Beginning to think she knows someone at the city. I want to know how she doesn’t follow the rules and is getting away with this. I will find out!

Tree Lady put in new windows, we checked, no permit for those either. Why do we need permits for everything? Would it be to protect potential home buyers from getting inferior workmanship? Somebody thought enough of that to make it a rule, but Oceanside doesn’t care, doubt they’re going to do a thing.

Why do we pay these salaries for people to think up stuff that isn’t enforced, and pay someone to not enforce the rules. Now I feel a need to figure out this problem and I’m going to get an answer from someone.

Tree Lady has a huge beehive living in the eves of her house. I’ve complained to the city for about 12 years now, before she moved here. I’m highly allergic to bees and they swarm in our yard on occasion, I’m not safe, have reported that to the city, but guess what , they don’t care. City of Oceanside won’t take care of the problem, nor will they ask the homeowner, Tree Lady,to do anything.

Oceanside just had a bee attack the other day, with about 6 people getting hurt. Who do I turn to with my legitimate problem with bees that can kill me? My city doesn’t care. When I get stung by one bee, it’s a trip to the hospital for me, if I’m lucky enough to get there before my throat closes and I die.

I thought city government was supposed to keep their residents safe, but obviously, I’m finding out I’m wrong! I don’t understand, as I thought the role of government was to create and maintain the rules for an orderly society. When in fact, they create the rules, and don’t enforce them, and allow neighbors to be terrorized, harassed, and to squabble in the streets. Something is not working in our government and I can see why.

Code violations are rampant at the end of my cul-de-sac!

Think how much all this is costing the City of Oceanside, to send police, code enforcement, etc. all because a group of gossiping neighbors chose to pick on us, and they have lots of code violations that I haven’t reported yet. We are fighters, not going anywhere, and every time I have a legitimate complaint, I will call the appropriate agency. Maybe I’m not talking to the right people yet, but I won’t stop until I find the answers.

BJA, my next door neighbor probably has numerous violations as he has built a fortress around his home. He started at the curb and built a concrete planter. using the city easement (code violation).

He built us a high fence, totally private, separating our yards. I thought, what a great neighbor! My son paid half and we were very happy. Little did we know this guy just erected a code violation for us. The fence is about 10 to 12 feet high and I believe city specs state it must be about 6 feet. Oh well, so guess we’ve joined the Cul-De-Sac-Code-Violator’s Club, thanks to that Big Jack Ass.

My son is talking about perhaps trimming down the fence to meet the city code. BJA is extremely paranoid as he has blocked in his front yard with canopies, our fence, etc. If my son cuts the fence to 6 feet, BJA would have a fit as we’d be able to see into his yard since our house is two stories.

I’m documenting every detail because when something happens because of all the rules that are being blatantly disregarded by these neighbors and the City of Oceanside, I will have my writings to remind them that they didn’t care!

If the city were to crack down on these rules, collect fines they are due, these people around here would straighten up and maybe fly right, but what’s happening now is they know they can get away with doing whatever they please, with no repercussions. And they are all repeat offenders.

This is making me angry with the city.

We are going to be remodeling; maybe we should just fall into line with the code offenders and not get any permits, because I know the city doesn’t really care and we can use the fee money for other things. I’ll spread the word to anyone I know that you don’t need to get permits, the city doesn’t enforce them .

Wow, I’m finding it easy to think like a code violator, since it’s so easy to get away with it! What’s next?

Criminal minds are born from stuff like this. I used to be concerned about breaking laws, but gee, if no one cares and everyone on my cul-de-sac gets away with whatever they want, why shouldn’t I?

I believe that BJA was the one who advised Tree Lady how to go about cheating the city on her curb cut, since he had an illegal curb-jumper made from wood in the street for years, until we complained and they did make him move that. Also, that could be part of his passion to fix things for her; perhaps he felt guilty for advice he gave her.

Big Jack Ass kicked into his super-anger when I told him if she didn’t move those trees that I’d be turning her in for her curb cut. Her ex-husband wasn’t living there when she first moved here, and she is definitely that “I need your help” type person who knew nothing about what to do. She was told by someone how to do what she did, and Big Jack Ass Code Violator is the most likely suspect who gave her the advice about her curb.

I would be a little afraid to cut into a city curb and have someone sneak in on a Sunday to do all the work, all without a permit!

What happens when she gets caught, NOTHING!!!

  1. You write very well.

  2. The City of Phoenix (AZ) is just as negligent. I made a blight complaint(code violation) in 2002 and the city never followed through – the rusty swamp cooler is still there.
I smelled bribry in 2002. I am trying again soon and will file a formal complaint against the investigator for harassment. Maybe you c ould do this with the investigator for the curb.

  3. You go girlfriend!

I have lived in Oceanside for more than 15 years and have had crazy neighbors in the past (none as crazy as yours) and they can make life miserable, you just keep doing what you are doing.

I am wondering if the Mayor is aware of all the code violations on your street that are being ignored?

  4. Thanks … Yes, my neighbors are EXTRA CRAZY and EVIL!
Yaki tells me that lots of our City Official’s are tuning into my blog … because it is JUST SO RIDICULOUS … and, I have spoken to the Mayor’s office, myself about what’s going on in Wonderland. My street did get repaved, and am thankful for that, however, Mr. Drip next door, is violating a federal law with his LONG TERM LEAKING. Oceanside does not care, because it’s not a Life or Death situation … yet!
Still waiting for a call back from Dave Manley, head of Code Enforcement; guess I called him about a month ago. He has told me before that leaking oil and transmission fluid on the street was only … technically … a code violation!

    Yaki is THE BEST!
