Rude Neighbors And Trees In Oceanside

Let’s rename the City of Oceanside, the City of Treeside. I’m making that proposal because you certainly can’t depend on your cherished Oceanside views.
Any neighbor, for whatever reason, can plant trees to block your ocean view, even on a city easement, and there are no ordinances to protect your investment, your equity in your home.
Other beach communities all over the country are recognizing that ocean views are very important to the residents and the city, enacting laws to protect this valued community asset. Think about how unpopular, the City of Oceanside will become when all the views to the ocean are blocked.
Buyer BEWARE of Oceanside, CA. What you see when you buy your property is not protected. You too could have a neighbor who would like to hurt you.
Ask yourself this question, why would a neighbor block another’s view? Spite? Rather RUDE, don’t you think, for your neighbor, to plant a curtain of trees, taking away your ocean view? My neighbor who planted the trees has a view, and I know she’d be very upset if someone took hers.
I tried all the neighborly remedies like offering to pay for re-landscaping, etc. but her purpose to begin with was to hurt me and you can’t reason with that.
When I talked with one of our city councilmen, I was told the City of Oceanside is predominately Republican and they wouldn’t be making any new laws to fix the problem. He stated there has been an informal poll to address this and no one cares enough to make a law, and it won’t happen.
Poll results depend on the way the question is asked:
•1. Would you like a new law that tells you what to plant in your yard? The answer would be NO.
•2. Do you think it’s ok for people in a beach city to plant bushy trees that wipe out the ocean views of residents, decreasing the city’s property values? The answer would be NO
Questions can be asked in a way to elicit any answer that you’d like!
When people find out they can be paying for property with an ocean view, then, their neighbors can just decide they’d like to plant trees, with no care about that view… they will not be happy to find out that there’s not one thing anyone will do, in the City of Oceanside, CA!
Buying a home in Oceanside, CA.? YOUR VIEW OF THE OCEAN MAY BE HERE TODAY… AND GONE TOMORROW… too bad, SOOOOOOOO SAD!
I have a good idea that the city is about ready to overbuild the beach area, and believe that’s why they’re not the least bit concerned with individual homeowners views.
Realtors should have to disclose that homeowners views ARE NOT PROTECTED to anyone buying a home in Oceanside, CA.
I contend that there are rules already to address this problem. Start with the “Golden Rule”.

Introduction :
I realize that the City council consistently votes for development and that the Coastal Zoning Commission has a very narrow responsibility to keep Beach development in check.
Previous city administrator’s of Oceanside have forfeited the golden opportunity, as Oceanside has the last developable Ocean front from Camp Pendleton to San Diego. It may already be to late!
This un planned development has left the community with many problems.

Oceanside has allowed a wall of 2-3 story houses all along Pacific Str, there are public access corridors, however the beach areas at high tide are minimal.
There obviously was no master plan to allow wide site walks on both sides of Pacific, landscaped public area’s. parking area’s for visitors.
Instead, the Beach was sold to private parties and the general public was given controlled access, by making it very difficult to park and to enjoy a public domain.
No master plan to develop public access , parking, green belt adjacent to the Beach and room for service industry
The Strand should have been put aside for only beach access, cities such as Santa Monica have removed private housing from their beaches and created Parking and recreation areas, ( the concept is a multi use planned area, Beach, park , parking ,street and Restaurant’s , food area belt) to allow public access.
They realized that well planned Beach areas can bring much Tax revenue and could revitalize the general Beach area of Oceanside.
Continues Unchecked private development has build a wall of neck to neck 2 to 3 story boxes, blocking the view to all neighboring development.
It appears to me that there are no questions on intended use for the new development when a permit to develop is requested.
What could have been a well planned Oceanside community, Pacific street sector has become an eye saw.
Does anybody realize that a City like Oceanside with a very large Disabled community, does not have one Disabled parking spot for access to the Beaches or Vacation Rental’s such as desribed below, on the length of Pacific Street. Not even in front of the newly completed Hotel. This is an outright discrimination and violation of The American’s with Disability Act and not very friendly to our citizen’s as well as visitor’s. There are only 5 marked Disabled parking places on Strand, one is hard pressed to find any on neighboring streets in the vicinity of businesses .
A check to determine who these Vacation Rental Investors that develop the Beach area under the obvious guise of building private Residences, are advertising that every unit has a Jacuzzi, obviously not intended to house a normal family. These listed owners live in Palo Alto, Los Gatos, Rcho Santa Fee and others are incorporated LLC.
Meanwhile S. Pacific is littered with FOR RENT and Vacation Rental Signs, some are using For Rent signs only, one would think that this would be considered deceptive advertising as I checked and found them to be Vacation Rentals only. Where is the Supervision by Oceanside City Inspectors, the City Planning Dept. pointed out that the Building’s of interested permit’s where issued for residential use. Every well managed City has applicable rules to control development and signage.
It is doubtful that these investors care about community., they live in well planned communities themselves.
The properties are managed by http://www.BeachfrontOnly.com, in Oceanside mainly 809/ 811/ 813/ 815/819/1023/ 1027/ 1029/ 1733.
These Vacation Rental businesses, appear to operate as Micro Hotels rather than conventional vacation Rental’s, as well as overnight rentals to visiting sports teams ETC, .They also run large wedding parties, mainly on the roof deck at building 809 S. Pacific Street. Lately on every weekend, we had to call the Police Dept. both day’s as the partying and drunken behavior did not cease till early morning hours.Are these parties kept to strict Fire Dept. scruteny as all restaurants in the city are.
How about disabled access as per standard legal provision’s.
A main problem for all of these Micro Hotels is parking, As an example
# 809 sleeps up to 15, unit has an under ground car Garage, with 8 parking spots, barely holding an SUV but would not hold 4 Van’s or trucks.
It does not appear that Guest’s like to park in that Garage as it has narrow bay’s, is very confined.
If all 4 buildings are rented, the following estimated parking spot’s are needed!
# 809A&B, sleeps up to 15 can accommodate 8 cars
# 811A&B, “ “ 26 “ “ 4 “
# 813A&B, “ “ 26 “ “ 4 ‘
# 815A&B, sleeps up to 26 “ “ 4 “
A Total of 93 person’s can be accommodated , it is reasonable to than assume that basically 93 can be divided to estimate the number of car’s per night ‘that brings us to 23/24 cars per night. In 20 parking spot’s, this leaves ¾ car’s to be parked on public roads.

Added to this , the service personal for this Micro Hotel, also parks Pickup trucks, and cars right in front of the 4 buildings, than outside contractors ,such as carpet cleaners , party supply trucks as well as delivery trucks often block the road.
However the problem is that a lot of guest’s prefer to park on the street as the car’s are stacked into 2 deep spots and are very narrow.
We the permanent residents along Pacific loose our curb side parking, get our driveways blocked and the city does not tow, they barely enforce parking rules after hours when guests arrive. There are many city sanctioned older apartments that all provide a 1 car garage per apartment, most apartments are occupied by at least 2 person’s , they park one car in their assigned garage and the other curbside. It has become almost impossible to park curbside as the guests of the Micro Hotels take up the spaces.
Parking around Pacific has become a nightmare for residents and guests alike. Beach goers have to walk quite a distance to the beach.
It is customary to charge a Tourist Tax to Guest that stay in Vacation Rentals throughout the State.
Have our City fathers thought about this revenue channel ? The owners of S. Pacific Vacation Rental’s charge from $ 1,500 to $16,500 per week, a pre Tax
Tourist Tax could greatly cover the extra cost of expanding needed parking and enforcing violations
Have received several letters from the City of Oceanside, notifying me and all residents around the 800 block of the intentions of owners to remove several old bungalows that face the beach, to than build as the notices state, private residences, re the conversation with the president of Beach Front Only, a DR. working at Palomar told us on 4 28-08 will be managed by his company, he made it known that he has excellent support and knows all of the Oceanside Council, he apologist to us for the rowdy Wedding party over the weekend, the second one within to weeks, Loud music and human behavior till early morning hours ,finally stopped by the Oceanside police after we called them .
The president ask us to assist him in calling his tenants that are violators to his attention, no doubt for the only reason to stop the City Gov. to know about these many violations that are more and more noticed by the community, a very negative impact on what could be an Oceanside paradise.
This attempt to pacify us is a one sided attempt as the company is asking the neighborhood to provide a security service for this business venture, allowed to exist in our neighborhood w/o public awareness, the city did not ask the many owners and tenants of the area for approval’s. the owners of the older apartment complexes and residences will suffer a loss of value as their ocean views have been blocked , tenants will move on as they cannot find adequate parking on the street, increasing losses .
The California Zoning Commission will hold a public hearing in April & May 2008, ETC.
disturbing the tranquility of the area.
If this company now is going to be allowed to erect several new units , the whole neighborhood will loose more Parking , the Beach is going to be totally blocked.
Where was the City council when this mess was created?
Could it be that they encouraged this madness?
Several neighbor’s are gathering in bringing this to public attention!

We are with you Joe! Our view is blocked by some VERY overgrown trees. We complained to Cal-Trans about the trees on the 5, and they’re coming down (though it’s purely coincidental)… Let us know how we can help!!
